What Is Chapter 35 Benefits

Chapter 35 is the section of federal law authorizing education and training benefits for eligible dependents of veterans rated as 100% Permanent and Total disabled. This program, also called DEA (Dependents' Educational Assistance), provides monthly stipends to spouses and children of veterans whose service-connected disabilities meet the permanent and total standard.

Your dependent qualifies if you received a 100% P&T rating from the VA before your death or while still living. The rating must be based on service-connected conditions, not non-service-connected disabilities. Dependents can use Chapter 35 benefits at accredited colleges, universities, technical schools, and vocational programs. The VA pays the eligible dependent directly, not the school.

Eligibility Requirements

To access Chapter 35 benefits, your dependent must meet these conditions:

  • You hold or held a 100% Permanent and Total rating for a service-connected condition
  • Your dependent is your spouse or child under age 23 (or 26 if on active duty at age 23)
  • Your child is unmarried and pursuing an approved educational program
  • Your spouse married you after the 100% P&T rating was granted (in most cases)
  • The education program is offered by an accredited institution or meets VA approval standards

The VA verifies your 100% P&T status through your VA file. If you're uncertain whether your current rating qualifies, contact your VA Regional Office or work with a Veterans Service Officer (VSO) to confirm your eligibility status before your dependent applies.

Benefit Amounts and Duration

As of 2024, Chapter 35 provides approximately $1,100 monthly for full-time enrollment. Part-time students receive proportional amounts based on credit hours. Benefits continue for up to 45 months of full-time training, equivalent to roughly 36 months at three-quarter time.

The VA adjusts these amounts annually in October based on cost-of-living increases. Your dependent's monthly payment depends on enrollment status and the type of program. Correspondence courses, apprenticeships, and on-the-job training also qualify under specific conditions.

How to Apply

Your eligible dependent applies directly to the VA using form 22-5490 (Application for Dependents' Educational Assistance). They'll need your service member information, Social Security number, and documentation of your 100% P&T rating. The application goes to the VA Regional Office handling your disability file.

Processing typically takes 30 to 60 days. Your dependent can track the application status through VA.gov or by calling the VA Education Support Center at 888-442-4551. Once approved, the VA certifies your dependent with the school and sends monthly payments directly.

Common Questions

  • Does my dependent lose benefits if they work part-time? No. Chapter 35 has no work restrictions. Your dependent can work while using benefits without reduction in payments, unlike some other VA education programs.
  • What happens if my 100% P&T rating is reduced? Chapter 35 eligibility is tied to your rating at the time your dependent's application was approved. If your rating drops below 100% P&T after approval, your dependent keeps existing benefits through completion of their current program.
  • Can my dependent use these benefits after age 23? Only if they were on active duty status at the time they turned 23. Otherwise, the benefit must begin before that birthday, though they can continue using it after turning 23 if already enrolled.

DEA and 100% Permanent and Total are directly connected to Chapter 35 benefits. Understanding your P&T rating and how the DEA program operates will help your dependents apply correctly and maximize their education benefits.
