What Is Discharge Upgrade

A discharge upgrade is a formal request to the military to change your characterization of service from a punitive or administrative discharge to an honorable discharge. Only an honorable discharge qualifies you for VA disability benefits, healthcare, and other federal veterans programs. If you received an other-than-honorable (OTH), bad conduct (BCD), or dishonorable discharge, you're barred from VA benefits until the discharge is upgraded.

The upgrade process goes through the military's discharge review boards, not the VA. Each branch maintains its own review authority: the Army Discharge Review Board, Naval Discharge Review Board, Air Force Discharge Review Board, and so on. You have up to 15 years from your separation date to file a request, though some cases are considered beyond that window if you can demonstrate extraordinary circumstances.

Eligibility and Requirements

You must submit your upgrade request on DD Form 293 (Application for the Review of Discharge from the Armed Forces) or DD Form 149 (Application for Correction of Military Record Under the Provisions of 10 U.S.C. 1552). The discharge review board examines the character of your discharge, circumstances of separation, and post-service conduct. They don't automatically grant upgrades. Your case succeeds when you demonstrate that the original discharge was unjust, improper, or resulted from factors beyond your control like undiagnosed PTSD or traumatic brain injury.

Having a strong nexus between your discharge circumstances and service-connected conditions significantly improves your chances. For example, if you received an OTH for misconduct tied to substance abuse, showing medical documentation of a service-connected substance use disorder strengthens your argument. Veterans organizations report upgrade success rates ranging from 20% to 40% depending on the branch and discharge type.

Connection to VA Disability Claims

Even if your upgrade is pending, you cannot file a VA disability claim with an OTH or worse discharge. The VA will deny your claim outright. This creates a timing issue: you must secure the upgrade first, then file your disability claim. Some veterans work with Veterans Service Officers (VSOs) to coordinate both processes simultaneously, preparing C&P exam records and nexus documentation while the discharge review is underway.

If you already have a denied VA claim due to discharge status, you can reopen it once your discharge is upgraded. File a new claim within one year of your upgrade approval to preserve any potential back-pay eligibility.

Representation and the Appeals Process

You can represent yourself in a discharge upgrade request, but many veterans use VSOs or military law attorneys. Some VSOs specialize in discharge upgrades and work through organizations like Veterans of Foreign Wars (VFW), American Legion, or Disabled American Veterans (DAV). Representation is free through VSOs but costs between $500 and $2,500 if you hire a private attorney.

If your discharge review board denies your request, you have one appeal to the Discharge Review Board for Correction of Military Records (DRBCMR). This second review is your final administrative remedy. After that, you can petition Congress, though success is rare.
